Topics Include:

We continue our popular Best Practice Series. In our new series of webinars we will again tackle the difficult disability access and accommodation compliance issues faced in postsecondary education. Salome Heyward will lead the legal compliance discussion during each webinar.

Webinar 1: The Compliance Mandates Regarding Accommodation Practices are Rapidly Changing (Replay Available)
There are a number of recent OCR rulings that raise compliance concerns about some common accommodation practices that many institutions use. We will discuss those rulings in detail and highlight those practices that may require modification in light of some administrative procedures that have failed to survive the close scrutiny of the federal enforcement agencies. Topics that will be discussed include:

  • Voluntary Note-taking…Should institutions continue to offer such services?
  • Offering test accommodations in a testing center or the disability services office… What are the practices and procedures that have been judged to be unduly burdensome or discriminatory for students with disabilities?
  • Alternative format practices… What delivery methods and procedures have been found to equal discrimination?
  • Student disagreements and faculty disputes… Does your institution have the proper procedures in place to manage these situations?

Webinar 2: Student Responsibility… What are the New Rules of Engagement? (Replay Available)
Have OCR and DOJ in their rulings and resolution agreements shifted the balance in favor of students to such a degree that postsecondary institutions are severely hampered in their ability to manage the behavior of students with disabilities? We will discuss a number of enforcement agency rulings that suggest that institutions should reassess their compliance obligations, as well as, the way in which they manage their interactions with students with disabilities. Topics that will be discussed include:

  • Documentation Standards: How should institutions deal with documentation that is incomplete, falsified, and otherwise insufficient?
  • Qualified Status Determinations: What is the proper way to balance students’ right to participate in the educational program and essential program requirements?
  • Questionable Accommodation Requests: Extreme Absenteeism; extended time that equals unlimited time; demands for absolute privacy and silence; and modification of course format and structure.
  • Behavioral Issues: What is a proper protocol for assessing and managing a student’s behavior that is a manifestation of his/her disability?

Webinar 3: Legal Updates and Compliance Issues on the Horizon (Replay Available)
This session will include a review of the important court decisions, settlement agreements and agency rulings of the year. We will also discuss the significant provisions of the recently published Final Rules Implementing the ADA Amendments, effective date October 11, 2016.
